In discussing the proposed FTC rule, Melissa recommended:

 

“[I]f you bring on a new employee who is coming from a competitor, whether [they] have an or agreement or not, that you be very careful and make it clear to the employee that they are not to use confidential information from the former employer….because you can get into trouble whether [they] have a noncompete or not.”
